Wike Lacks Constitutional Power to Close Borders over COVID-19

A Facebook user by name, Comrade Wisdom Chapp-Jumbo has opined that the Governor of Rivers State, Nyesom Wike does not have the constitutional Power to closer land borders and stop flights from coming into the state, profjaysblog reports.

Comrade Wisdom Chapp-Jumbo further stated that it’s only the President of Nigeria, President M. Buhari that has the constitutional power to do so by declaring a state of emergency across the country.

Below is what he said:

Governor Wike lacks the constitutional powers to ban flights and anyone from entering Rivers State at 6pm today. No military, police or any government agency will take orders from him in this regard. He is not the President.

While I strongly believe a total lock down is what the state currently needs at this time as we fight this #COVID19 pandemic, the Governor can only advise residents to stay at home but can not place a total ban on entry to the state when he lacks the constitutional provisions to do so.

For a total lock down of any state to happen, President Buhari needs to declare a State of Emergency in accordance to the provisions of section 305 of the constitution to back the efforts of various State Governments to have a complete lock down of a state.

“Governors making draconian orders that severely limit liberties of citizens without a State of Emergency being first declared by the President is not consistent with constitutional democracy regardless of the noble intentions.”

This means disobeying this orders by the Governor will not be a crime under the law. The president needs to act very fast.

  1. Are you not mad??? You agreed his decision is the best for what his state is passing through yet you are talking about Constitutional power. If the FG doesn’t exercise his powers does it mean the people of Rivers state should perish. Wike I love and support you for your courage Sir. God bless you.     • That something is right does not make it expedient. Did you read with an open mind? You need to do that in order to see the real message and stop ranting.
